"He basically got in my face, damn near nearly touched me", Irizarry is heard saying to the camera during the incident.

But the Forest Preserves of Cook County announced on Twitter that Connor decided instead to leave the preserves' police force, which he had served since 2006. The officer, identified by authorities as Patrick Connor, resigned Wednesday night. The report alleges he was intoxicated.

Timothy Trybus has been released from jail on bond and is scheduled to appear in court on August 1 for a hearing on hate crime charges. Trybus was arrested and charged with two counts of felony hate crime, an upgrade of the initial charges against him, which were misdemeanor assault and misdemeanor disorderly conduct.

Cook County Commissioner Jesus "Chuy" Garcia called Connor's resignation "a commonsense decision after his inaction and failure to serve Cook County".

"A charge for simple assault or disorderly conduct is not sufficient", García said.

Forest Preserve District Police Chief Kelvin Pope said Connor "should've stepped in, and he should've done something".

Trybus will be represented by a public defender, but one has not been assigned to him yet, the public defender's office said.

It was not immediately clear if Trybus had an attorney to comment on his behalf.

Randall said his agency has apologized to Irizarry and refunded the money she had paid for a permit to gather at a picnic table area on the day of the incident.

"We don't know what was happening outside the video; we don't know what was going on inside his (Conner's) head at the time", the attorney, Tamara Cummings, said Thursday.

'You're not going to change us, you know that, ' Trybus tells her in the clip. "Are you a citizen?"

"Are you a citizen?" he's also heard saying.

The video also shows Irizarry ask a nearby officer, Connor, for help, but he does not appear to intervene.

"The craziest thing is there's all these cops here and I still don't feel safe", she later adds.

This is certainly not the first time, but right now we are in a moment of history when Americans are being told to fear other Americans and one of the reasons I think the video went viral is because it is emblematic of our times. "Is there anything you can do?"

But the officer continues to do nothing or even move closer to Irizzary as the man continues to approach her.

Mr Trybus continued to harangue Ms Irizarry for about 10 minutes before other officers arrived and arrested him. "Are you a United States citizen?" he screamed, referring to the shirt as "un-American". If you were American, you wouldn't wear that.

"OK, OK", Ms Irizarry says, trying to placate him.

"And when you're drunk, you don't belong here", the officer tells Trybus.

But he said the officer considered it "an unfortunate incident" and felt he was not "given a fair shake".

Irizzary was wearing a shirt made to look like the Puerto Rico flag, with the words "Puerto Rico" written on the top.
