Prosecutors pointed to audio of Stockley threatening to kill Smith during the chase and alleged the former officer planted a gun in Smith's auto to justify his actions.

Stockley waived his right to a jury trial leaving his fate to be determine by 22nd Judicial Circuit Judge Timothy Wilson despite prosecutors' objections.

St. Louis Metropolitan Police Chief Lawrence O'Toole released a statement Friday advocating for any protesters to demonstrate peacefully following the Jason Stockley verdict. Activists vowed mass disruption like the sort seen during the Ferguson, Missouri, protests if Stockley wasn't handed a guilty verdict. Bianci holstered his weapon while standing by the driver's side of Smith's vehicle at the fast food restaurant where Stockley claims Bianchi yelled gun. "THIS AIN'T RIGHT" In recent years grand juries have declined to charge officers involved in the 2014 fatal shooting of Michael Brown, 18, which set of nights of violent protest in Ferguson, and the choking death of Eric Garner, 43, in NY.

The fact that Anthony Smith was shot and killed by Stockley is not in dispute.

The judge also referred to Smith as an "urban heroin dealer" and said that it would not be "an anomaly" for him to possess a gun. Our values of Respect, Responsibility, Discovery and Excellence guide all of us, and we remain committed to free expression, but that expression must be shared in a peaceful manner.

Following the judge's ruling, people gathered outside of the courthouse to protest. In a video obtained by the St. Louis Post-Dispatch, Stockley can be heard saying that he's "going to kill this motherf****r".

Stockley and Bianchi pursued Smith and at some point, the police vehicle crashed into Smith's Buick, the report said.

She later said that in such shootings "we must re-examine not just how we prosecute these cases but how investigate them".

Missouri Governor Eric Greitens said earlier this week the state's National Guard had been activated to safeguard city residents and property.

"I'm sad, I'm hurt, I'm mad", the Reverend Clinton Stancil of the Wayman AME Church in St. Louis told Reuters by telephone. Stockley fired seven shots as Smith sped away. Stockley testified he was acting in self-defense. Stockley's partner was driving the police SUV, which chased Smith at more than 80 miles per hour.

According to a probable cause statement attached to the first-degree murder charge, Stockley shot into Smith's auto in north St. Louis on December 20, 2011, then pursued him at more than 80 miles per hour.

Prosecutors believe Stockley's claim that Smith had a gun and was reaching for it at the time of the shooting was not corroborated by any of the videos or scientific evidence, nor by the actions and reactions of his partner.

But prosecutors questioned why Stockley dug into a bag in the back seat of the police SUV before returning to Smith's vehicle.

Barricades were placed around the civil and criminal courthouses as well as the police department to prepare for protests. Stockley is accused in the 2011 killing of Lamar Smith following a high-speed chase.
